CLAY CLUB PARTICIPANT WAIVER & ACKNOWLEDGMENT

PLEASE READ CAREFULLY. THIS AGREEMENT INCLUDES AN ASSUMPTION OF RISK AND RELEASE OF LIABILITY.

By participating in a class, workshop, open studio session, event, or other activity at Clay Club Seattle LLC (“Clay Club”), I acknowledge and agree to the following:

Age & Capacity

I confirm that I am 18 years of age or older and legally capable of entering into this agreement.

If the participant is under 18, a parent or legal guardian must complete any required minor-participant acknowledgment or consent.

Assumption of Risk

I understand that pottery, ceramics, and participation in a working ceramics studio involve inherent and ordinary risks.

These may include, but are not limited to:

  • slips, trips, and falls;

  • cuts, scrapes, punctures, pinching, or other injuries involving pottery tools, equipment, shelving, clay, or fired ceramic work;

  • injury associated with pottery wheels or other studio equipment;

  • lifting, repetitive motion, or strain;

  • contact with clay, glaze, dust, silica-containing materials, cleaning materials, and other substances commonly used in ceramics;

  • skin irritation or allergic reactions;

  • burns or injuries involving hot ceramic work, kiln areas, or other heated surfaces; and

  • the actions of other participants or other ordinary hazards associated with a shared ceramics studio.

I understand that not every possible risk can be listed.

I voluntarily choose to participate and knowingly accept and assume the inherent and ordinary risks associated with these activities.

RELEASE OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY WASHINGTON LAW, I RELEASE AND HOLD HARMLESS CLAY CLUB SEATTLE LLC, ITS OWNERS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AGENTS, AND REPRESENTATIVES FROM CLAIMS FOR PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM MY PARTICIPATION IN CLAY CLUB ACTIVITIES, INCLUDING CLAIMS ARISING FROM ORDINARY NEGLIGENCE.

THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESS OR INTENTIONAL MISCONDUCT, OR OTHER LIABILITY THAT CANNOT LAWFULLY BE WAIVED.

I understand that by agreeing to this section, I am giving up certain legal rights with respect to claims covered by this release.

Studio Rules & Safety

I agree to follow Clay Club studio rules, posted safety procedures, and reasonable instructions from Clay Club staff and instructors.

I agree to use pottery wheels, tools, materials, and other equipment only as intended and to refrain from using restricted equipment unless I have been specifically authorized or trained to do so.

I understand that kilns and certain other equipment may present significant heat, electrical, mechanical, or other hazards and may not be accessed or operated without authorization.

Clay Club may require a participant to stop an activity or leave the studio if their conduct creates an unreasonable safety risk to themselves or others.

Emergency Assistance

If I experience an injury or medical emergency while participating at Clay Club, I authorize Clay Club staff to contact emergency medical services or seek reasonable emergency assistance when they believe it is appropriate.

I understand that I am responsible for any medical expenses incurred on my behalf.

Ceramic Work & Personal Property

I understand that ceramics is an unpredictable process and that ceramic work may crack, break, warp, glaze unexpectedly, be damaged, or fail during drying, handling, glazing, firing, storage, or other studio processes.

Clay Club cannot guarantee the successful firing, preservation, or return of ceramic work.

To the extent permitted by law, Clay Club is not responsible for ordinary loss of or damage to personal belongings or ceramic work left at the studio.

Acknowledgment

I HAVE READ AND UNDERSTAND THIS PARTICIPANT WAIVER & ACKNOWLEDGMENT. I UNDERSTAND THAT IT INCLUDES AN ASSUMPTION OF RISK AND RELEASE OF CERTAIN CLAIMS, INCLUDING CLAIMS ARISING FROM ORDINARY NEGLIGENCE. I VOLUNTARILY AGREE TO ITS TERMS.
